Unabbreviated Legal Terms and Conditions
Scope of Work:
Ron's Restoration Masonry agrees to perform the Services described in the proposal and any attached specifications, drawings, or documents.
Performance of the Work based on the Project Schedule:
- Contractor agrees to perform the work in a prompt and diligent manner so as to ensure the uninterrupted progress of the Project, and in accordance with the Project Schedule as stated above, Contractor agrees to complete the work as rapidly as field conditions permit, proceeding in a skillful and expeditious manner, with sufficient labor, materials, tools, equipment, supplies and all other resources necessary to ensure that the work will be completed in accordance with the Project Schedule.
- Contractor shall achieve substantial completion of the base contract work not later than the stated substantial completion date listed above. This date is subject to adjustment by Change Order as elsewhere provided in this Contract. Contractor hereby acknowledges and agrees that the Substantial Completion Date shown on the Project Schedule is reasonable for completion of the work.
- The work shall attain Final Completion on or before the Final Completion Date as set forth in the Project Schedule.
Updates to Project Schedule:
Contractor agrees to make revisions to and update the Project Schedule regularly. Contractor shall meet with Owner on a regular basis to discuss issues relating to the Project Schedule.
Time of the Essence:
Contractor further acknowledges that the timely performance of the work in accordance with the Project Schedule is "of the essence" of this Contract. This "time of the essence" requirement shall apply to all dates, time limits and time requirements including, but not limited to, the Substantial Completion Date, set forth in this Contract and in the Project Schedule.
Requirements for Substantial Completion:
The work (or a designated portion thereof) shall be deemed to have attained Substantial Completion when the Project (or any designated portion thereof) is sufficiently complete in accordance with the Contract so that, insofar as the work performed by Contractor, Owner can occupy or utilize the Project (or that designated portion) for its intended use, except for minor items of non-conforming work to have attained Substantial Completion.
